Overview at a Glance – Wills and Lasting Power of Attorney

A Will is an important legal document that allows you to leave your assets to people who you choose.

If you don’t have a Will you die intestate and the government decides how your estate is distributed.

A Will is useful if you have children under 18, it allows you to set out who the guardians should be if you pass away. It can sometimes be the case that parents pass away together and children have to go into care until the Court decides the child’s fate, a Will can prevent this from happening.

In my experience a Will is best accompanied by Power of Attorney as a Will cannot deal with issues whilst you are alive.

A Lasting Power of Attorney ensures that your health and finances will be looked after if you physically or mentally lose the capacity to handle your affairs for example long term illness, dementia or if you’re in a car crash.

In addition to structuring your personal legacy, a Will is an integral tool for business owners to ensure that their families benefit from their business in the event of their demise, or to facilitate continuity in family businesses that have been long established.
